Controlling or coercive behaviour in an intimate or family relationship |
abstract |
On 29 December 2015 the Serious Crime Act 2015 s.76, which created the new offence of "controlling or coercive behavior in intimate or familial relationships", came into force. On the same day, the Government published the statutory guidance framework, required under s. 77. The new offence is complicated, and is explored in further detail in this issue where Vanessa Bettinson asks whether Scotland should follow the path of England and Wales in criminalizing coercive control as a separate offence. There is an important debate to be had. Here, Padfield details the scope for legal arguments regarding coercive behavior of family relationship. |
