abstract |
Mother demonstrated a lack of willingness to participate in any of the many treatment programs offered by the state, which had provided remedial and rehabilitative programs to prevent the breakup of the Indian family. State court had concurrent jurisdiction with Indian tribes over termination of parental rights proceeding. The trial court erred in placing an Indian child in foster care without an explicit determination that mother's continued custody would result in the children's emotional or physical damage, which is supported by testimony of a qualified expert witness. Neither claim nor issue preclusion bars a husband's tort suit against his wife for abuse of process, defamation, and emotional distress after the divorce became final. Trial court did not err in not considering evidence of husband's extramarital affairs in a wrongful death suit against a doctor and hospital, because the evidence was not relevant in determining the damages in this case. |
